Spett.le Consob, siamo un gruppo di azionisti Cell Therapeutics (CTIC.MI - ISIS: US1509346029) che da alcuni giorni sta richiedendo alla Società dei chiarimenti in merito alle tempistiche di approvazione della sua richiesta di autorizzazione al commercio presso la EMA del suo farmaco Pixantrone (Pixuvri).
Purtroppo la Società non risponde oppure risponde in maniera molto ambigua e superficiale.
In base ai regolamenti della EMA (l'Agenzia Europea che concede le autorizzazioni al commercio di farmaci) ci risulta che il responso del "Committee for Medicinal Products for Human Use" (CHMP) avviene dopo 210 giorni dalla validazione della richiesta (17/11/2011); a questo tempo va aggiunto il periodo necessario alla Società per rispondere ai quesiti presentati dalla EMA il 120° giorno (attraverso una LoQ).
In un suo precedente comunicato ufficiale, Cell Therapeutics ha dichiarato di aver risposto ai quesiti posti dalla EMA in data 23/08/2011.
Se ne deduce che il responso definitivo del CHMP dovrebbe avvenire in data 23/11/2011 (cioè 90 giorni dopo il giorno 120), a meno che il CHMP non abbia emesso entro il 180°, cioè il 23/10/2011 una "LoOIs" ( Letter of Outstanding Issues) richiedendo ulteriori delucidazioni.
Nonostante le nostre ripetute richieste di chiarimento sulla decorrenza dei giorni 180 e 210 (oppure sulla eventuale ricezione della LoOIS) la società non fornisce notizie o date precise, ma solo risposte evasive e generiche.
Poichè riteniamo che la massima precisione e trasparenza siano alla base di un corretto rapporto tra la società (che attualmente si trova inserita nella Black List di CONSOB) ed i suoi azionisti sia fondamentale al fine di evitare manovre speculative di qualunque genere, Vi richiediamo cortesemente di intervenire richiedendo alla Società Cell Therapeutics di emettere un comunicato nel quale si chiarisca in modo esaustivo e inequivocabile quanto segue:
1) la data in cui sono state depositate le risposte ai quesiti del giorno 120 posti dal CHMP alla Società;
2) la data in cui la Società ha ricevuto dal CHMP il "Parere preliminare" del giorno 150;
3) la data in cui la Società ha ricevuto la eventuale LoOIS (Letter of Outstanding Issues);
4) quanto tempo ha a disposizione Cell Therapeutics per rispondere alla LoOIs ;
5) la conseguente data in cui verrà fissato il responso definitivo del CHMP del giorno 210.
Con la certezza che, grazie all'autorità prevista dalle Vostre competenze e nell'interesse della collettività, trasferirete immediatamente queste fondamentali richieste di trasparenza alla Società, restiamo in attesa di un Vostro cortese riscontro.

We are a group of shareholders that have invested in Cell Therapeutics, symbol CTIC, Isin: US1509346029.
We have arrived at a certain stage with our investment, whereby we and the company are waiting on a critical decision from the EMA (European Medicines Agency), regarding the MAA (application) for CTIC's drug pixantrone.
Based on the EMA's published approval timescales and associated schedules, we believe that in November, during the CHMP meeting that occurred from the 14th to 17th November, a critical review of the pixantrone application occurred.
Unfortunately, in the CHMP report published after the meeting, there was no reference to pixantrone, which leaves us completely unclear as to current status.
Now, a 'negative opinion' (one of the potential outcomes) would we believe have been considered to be a material event, requiring the company to issue an immediate PR to advise shareholders of such an outcome, and since no such PR have been issued by the company, we believe there remain some open issues regarding the pixantrone application, that the company has still to address.
According to the EMA's own procedure, we believe the company may now have been asked to respond to a 'list of outstanding questions/LOI', or indeed may be required to respond to such an LOI request via an oral presentation to the CHMP committee.
However, our concern is this - at such a critical time, we believe it is only reasonable that the company should have issued some form of statement to its investors, following the November CHMP meeting, to appraise us of current status.
As you will appreciate, in the absence of such an updatate from the company, shareholders are left in a position, whereby they cannot sensibly determine whether to continue to retain their investment/shares in CTIC or in fact sell the shares, in order to minimise any potential loss(es). You will be aware, that CTIC's share price has reduced in value by around 50% since the period following the reverse split, and of course we have seen considerable dilution over the last 12 months as well.
We feel it is perfectly reasonable to request that the company should issue us some form of update, and request your assistance in enabling us to secure this critical update from the company.
