Optional interest deferral:
The Issuer may elect to defer for each Series of Notes the payment of interest which
will be due and payable (fällig) on an interest payment date, upon giving not less
than 10 and not more than 15 business days' prior notice to the Holders of the
relevant Series of Notes.
If the Issuer elects not to pay accrued interest on any interest payment date, then it
will not have any obligation to pay interest on such interest payment date. Any such
failure to pay interest will not constitute a default of the Issuer or any other breach
of its obligations under the relevant Series of Notes or for any other purpose.
Deferred interest payments will not bear interest.
Optional payment of deferred interest payments:
The Issuer may pay outstanding deferred interest payments (in whole but not in
part) at any time upon giving not less than 15 business days' notice (which notice
shall be irrevocable and will oblige the Issuer to pay the relevant deferred interest
payments on the payment date specified in such notice).
In sostanza, se non ho mal inteso, l'emittente 1) può decidere di rinviare il pagamento degli interessi dovuti, con congruo preavviso, senza che ciò costituisca default; 2) può decidere di non pagare del tutto gli interessi dovuti alla data di scadenza degli stessi senza che ciò costituisca default o altra violazione degli obblighi assunti; 3) qualora l'emittente decida di pagare gli interessi in precedenza sospesi dandone congruo avviso, sarà vincolato a farlo in tutto e non in parte.
