    November 14, 2017: The Americas DC met on Tuesday, November 14th, to continue the discussion of whether a Failure to Pay Credit Event had occurred with respect to Petroleos de Venezuela, S.A. While the DC works to obtain clear information regarding the timing of payments made to the paying agent, as required to discharge the issuer’s obligations under the indenture, the DC has resolved to postpone holding a binding vote on this question. Market participants may submit any relevant Publicly Available Information to the DC Secretary. The DC agreed to reconvene on Thursday, November 16, 2017, at 2 pm (New York time) to continue the discussion.

El gobierno nacional prorrogó por 12° vez el estado de excepción y emergencia económica, decreto que le permite gobernar sin la autorización de la Asamblea Nacional para tomar decisiones en materia económica y financiera.

En Gaceta Oficial N° 41.276, de fecha 10 de noviembre de 2017 se publica el la prórroga del decreto por 60 días, mediante el cual se declara el Estado de Excepción y de Emergencia Económica en todo el Territorio Nacional, dadas las circunstancias extraordinarias en el ámbito social, económico y político … a fin de que el Ejecutivo Nacional adopte las medidas urgentes, contundentes, excepcionales y necesarias para asegurar a la población el disfrute pleno de sus derechos, preservar el orden interno, el acceso oportuno a bienes, servicios, alimentos, medicinas y otros productos esenciales para la vida.

El primer decreto de emergencia económica y estado de excepción fue propuesto por Nicolás Maduro en enero de 2016, y ha sido renovado consecutivamente pese a que la Constitución Nacional establece que es prorrogable solo una vez por 60 días.

La Asociación Internacional de Swaps y Derivados (ISDA), que reúne a tenedores de bonos, volvió a aplazar una decisión sobre si la estatal venezolana PDVSA entró en cese de pagos y dijo esperar más informaciones.

En un escueto comunicado la entidad informó que se reunirá nuevamente el jueves en Nueva York “para continuar las discusiones” y determinar si los acreedores pueden activar los seguros (credit default swap).

Se preveía que la ISDA decidiera hoy si Venezuela caypo en default por el retraso en el pago de 1.161 millones de dólares correspondientes al bono PDV2018, que venció el pasado jueves 9 de noviembre.

The International Swaps and Derivatives Association organises groups of finance industry representatives involved in trading “credit-default swaps” – a kind of insurance against debtors reneging on their obligations – to decide in each case whether the CDS should be triggered. The Isda “determinations committee” accepted the case last week, but decided to punt a final decision on PDVSA’s late payment of a $1.1bn bond at its meetings on Nov 10, 13 and now Nov 14, most likely due to the complexity of the situation. PDVSA belatedly made the bond payment late last week, but that raises questions of whether a CDS-triggering “failure to pay” has really occurred. Separately, however, the Isda committee accepted a request to make a decision on Venezuela itself, after S&P said the country had defaulted after missing $200m of payments due late on Monday. That case will be heard on Nov 15. The missed payments represent what will likely be the first in a cascade of defaults on Venezuela’s $60bn debt pile, leaving investors, analysts and officials scrambling to get on top of an increasingly chaotic situation for the stricken Latin American country. Oil-rich Venezuela managed to service its debts much longer than many investors had expected after the 2014 energy price collapse, but Venezuelan president Nicolas Maduro finally admitted defeat two weeks ago, announcing that the country would have to “refinance and restructure” all its foreign debts. Bond prices that had begun to recover from the fright of the restructuring announcement in early November on Tuesday duly fell back to trade near their record lows of cents on the dollar, underscoring the expectation of a protracted process and subdued recoveries.

(Reuters) - Venezuela contrató a un abogado especialista en reestructuraciones para asesorar al país con problemas de liquidez en su intento por renegociar unos 60.000 millones de dólares de deuda externa, dijeron fuentes cercanas al asunto a IFR, un servicio de información financiera de Thomson Reuters.
