Questo è il problema della nuova legge fallimentare italiana di Monti :tie: dove la proposta la presenta il debitore senza lasciare al creditore possibilità di scelta o margini di trattativa. Negli Usa il ricorso al "Chapter 11" (non in tutti i casi) prevde che anche i creditori possano formulare una proposta.

Munich / Planegg, 8 May 2013 – telegate AG today announced that it once again succeeded in significantly improving the profitability of its media business in the first quarter of the 2013 financial year. At EUR -0.9 million, earnings before interest, taxes, depreciation, amortisation and special effects (EBITDA) in the Media segment were up considerably compared with the previous year (Q1 2012: EUR -1.7 million). The company also managed to further reduce the contract termination rate of business customers by introducing attractive additional services.

The consolidated revenue generated by telegate AG in the first quarter of 2013 totalled EUR 19.9 million (Q1 2012: EUR 25.2 million). Of this amount, EUR 7.9 million (Q1 2012: EUR 8.8 million) were attributable to the media business whereas directory inquiry services accounted for revenue of EUR 12.0 million (Q1 2012: EUR 16.3 million). The Spanish business contributed EUR 1.1 million to consolidated revenue (Q1 2012: EUR 1.7 million). Consolidated EBITDA before special effects as at 31 March 2013 totalled EUR 3.3 million (Q1 2012: EUR 3.9 million). Since telegate AG now capitalises the cost of acquiring new customers and amortises it over the term of the contracts in accordance with IAS accounting rules, the earnings guidance for the current 2013 financial year based on EBITDA before extraordinary items is raised from EUR 8 to 10 million to EUR 11 to 13 million. The previous year's figures were adjusted accordingly.

In the operating business, an important strategic move was made in the first quarter with the development of new local services. Together with the international app provider AroundMe, telegate now offers a service that is unique throughout Europe: All businesses in Germany can quickly promote special offers for free and target walk-in customers with discounts. With more and more consumers searching for local information using mobile devices, telegate is closing yet another important marketing gap for small businesses with its new service. The 11880.com and klickTel apps from telegate have been installed more than 2.0 million times on mobile devices by the end of March 2013. Furthermore, all business customers now receive regular analyses showing the impact created with their invested advertising budgets. By launching innovative services for business and other customers, also in its core directory assistance business telegate continues as best as possible to compensate declining searches via phone.
