Lehman Says €411M Swaps Claim Can’t Use Good Faith Test

Lawyers for a unit of failed bank Lehman Brothers Holdings Inc. fighting a €411 million ($436 million) suit over canceled swaps contracts claimed in London’s High Court on Tuesday that the tests of good faith and rationality do not apply to the “hard” contractual terms of the swaps.

David Wolfson, the barrister representing Lehman Brothers Finance AG at trial, said that while the two investment companies bringing the claim can largely choose how to calculate their loss, the contract terms force them to determine the loss.

Le agenzie di rating: un argomento caro a molti, chiaro a pochi!

Personalmente ho sempre sostenuto che il problema non fosse rappresentato tanto dalle AdR, quanto piuttosto dall'uso distorto ed improprio che ne hanno fatto le banche italiane per perorare la vendita di titoli speculativi ad una clentela del tutto priva di elementi cognitivi.

Li' c'è il vulnus!

Ed infatti le cause che hanno visto le ADR convenute in giudizio per responsabilitè aquiliana ( extracontrattuale, come nel caso di Milano ) si sono risolte con un nulla di fatto, se non addirittura con la candanna pesante degli attori risparmiatori al pagamento delle pesanti spese processuali e delle onerose CTU ordinate dal magistrato giudicante, oltre ulteriori spese di CTP.

Siamo in attesa di comunicazioni ufficiali dalla procedura fallimentare di New York City riguardanti data e percentuale della prossima distribuzione. A mio parere gli 800 milioni di dollari di provenienza JPM difficilmente potranno rientrare in questa tornata.
