Il calendario del giudice Martin Glenn è pieno di udienze che riguardano altri casi di chapter 11, alcuni dei quali passati a lui a causa del pensionamento del giudice che lo preceduto, Chapman.
Sta di fatto però che ad oggi non sia stata ancora fissata neppure una udienza sul caso LBHI!

Terminiamo anche questa settimana senza l'ombra di un briciolo di progresso della procedura fallimentare.
Anche l'agenda del giudice Glenn ci mostra questa problematica con l'assenza di LBHI nell'agenda delle sue udienze presso il tribunale fallimentare di NY.
Tutti gli interessati alla vicenda si stanno accapigliando sul significato di questa frase: "senior creditors are satisfied/ not satisfied in full"!
Secondo alcuni ciò vorrebbe dire che i creditori senior unsecured ( cioè noi ) dovrebbero essere soddisfatti al 100% del credito vantato.
Secondo altri invece vorrebbe dire che ci si potrebbe considerare totalmente soddisfatti una volta ricevuto il saldo delle attività finali ( cioè una volta che la procedura fallimentare abbia verificato che non c'è più nulla da fare e , quindi, dichiara chiusa la propria attività ) anche se il totale degli importi ricevuti con le varie distribuzioni dovessero non corrispondere al 100% dell'investimento iniziale.
Non so se sono stato sufficientemente chiaro.
Con questo dubbio amletico auguro a tutti un buon weehend.
