Grecia, approvata la Legge Fast-Track per gli investimenti

Il disegno di legge sull´accelerazione e la trasparenza delle procedure di investimenti strategici, denominata ´Fast-Track´, è stato approvato dal Parlamento, con i voti di PASOK, ND e LAOS. Il Ministro di Stato greco, Haris Pamboukis ha inoltre annunciato che entro tre mesi verrà discusso un successivo disegno di legge per completare il quadro normativo in materia di investimenti.
La legge prevede che gli investimenti definiti ´strategici´ per l´economia del Paese potranno usufruire di un percorso più veloce (fast track). Tali investimenti riguardano la costruzione, la ristrutturazione, l´ampliamento o l´ammodernamento nei settori delle infrastrutture e reti, industria, energia, turismo, assistenza medica, gestione rifiuti, opere di alta tecnologia e innovazione, informa l´ICE. Per usufruire della ´fast track´ gli investimenti devono rientrare in una delle seguenti casistiche:
a) il costo globale deve essere superiore ai 200 milioni di euro;
b) il costo globale deve essere superiore ai 75 milioni di euro e creare 200 nuovi posti lavoro;
c) si prescinde dall´importo se nell´ambito dell´investimento vengono dedicate risorse per almeno 3 milioni di euro per triennio in opere di alta tecnologia e innovazione;
d) si prescinde dall´importo se dall´investimento scaturiscono 250 nuovi e duraturi posti di lavoro, oppure si favorisce la protezione ambientale della Grecia o si creano plusvalore nell´ambito dell´istruzione, della ricerca e della tecnologia.
Gli investimenti possono essere realizzati da soggetti pubblici, privati o in partnership pubblico/privato (legge 3389/2005).
Per quanto riguarda la valutazione della ´strategicità´ degli investimenti, questa verrà stabilita dall´agenzia governativa Invest in Greece S.A., che fa capo sia al Ministero dello Sviluppo Regionale e della Competitività che al Ministro di Stato Pamboukis, alla quale viene accordata anche la possibilità di controllo della realizzazione dei progetti, in raccordo con la Commissione Interministeriale per gli Investimenti Strategici (DESE), costituita dai principali Dicasteri del Governo.
La Commissione Interministeriale è tenuta a fissare i dettagli procedurali dell´investimento, mentre il Parlamento, salvo casi espressamente previsti dalla legge, non è titolato ad intervenire nel merito di detti progetti. Invest in Greece sarà incaricata di acquisire le licenze necessarie per conto dell´investitore privato, rilasciando una propria valutazione del progetto entro 15 giorni e segnalando alla DESE se l´investimento rispetta i requisiti necessari.
Quindi, entro un mese dovrà esprimersi a favore o contro l´investimento, trascorso il quale, anche senza un esplicito parere, il progetto verrà considerato automaticamente approvato.
