Nel caso, la polizza stipulata tra la fiduciaria e l’assicurazione (e in cui il cliente-fiduciante assumeva formalmente il mero ruolo di soggetto il cui evento morte era presupposto di erogazione dell’indennizzo), ancorava l’obbligo di erogazione dell’indennizzo all’andamento dei titoli di debito emessi dalla banca Lehman Brothers, senza garanzia di «conservazione del capitale» versato. Strutturato in questi termini il prodotto, in seguito al default della società finanziaria americana, nulla era dovuto all’assicurato.

In a recent decision, the Court of Appeal has ruled on the meaning of the words "fair market value" in the default valuation provisions in the Global Master Repurchase Agreement 2000 edition.

The claim was brought by LBI EHF, formerly Landsbanki Islands hf, relating to repurchase or "repo" trades entered into between LBI and Raiffeisen Zentral Bank Österreich AG, now Raiffeisen Bank International AG.
