La Corte d'appello di Brescia, ribaltando una precedente sentenza del Tribunale di Mantova, ha dato ragione a tre risparmiatori che nel febbraio 2008 avevano acquistato da Banca Fideuram obbligazioni Lehman Brothers


Lo rende noto l'associazione di tutela dei consumatori Konsumer, affermando che "l'istituto di credito era venuto meno ai propri obblighi informativi, relativi, tra l'altro, alla natura del titolo, alla situazione della società emittente, compreso il suo rating: è questa per la Corte la prova che, ai sensi dell'art. 21 del Tuf e dell'art. 28 del regolamento Consob del 1998, è l'intermediario che deve fornire e che nel caso specifico sarebbe mancata. Il giudice d'appello ha quindi pronunciato la risoluzione del contratto d'acquisto, condannando Fideuram alla restituzione del capitale investito, detratta la somma di circa 20.500 euro ricevuta dalla procedura concorsuale statunitense, ossia circa 23.400 euro oltre interessi e rivalutazione monetaria, decorrenti dalla data dell'investimento e spese di lite", conclude l'associazione dei consumatori.

La lunga sentenza del Tribunale di Brescia "è importante - spiega l'avvocato Giovanni Franchi, che ha seguito il caso in Appello per i risparmiatori - anche per aver riconosciuto il fatto che interessi e rivalutazione monetaria devono essere fatti decorrere non dalla domanda di risarcimento, ma dall'acquisto dei titoli".

Nulla di più falso! Anche la mia piccolissima banca fa parte del gruppo ICCREA ma sono sempre stati puntuali come un orologio svizzero. A meno che l'ISIN delle tue non sia particolare. (?)
