Avevo prontamente segnalato questo cambio di rotta conseguente sia alle risultanze delle molteplici udienze presso la Corte fallimentare dedicate a questo argomento, sia all'ultimo report LBHI.

In realtà, come più volte ti ho scritto, sono stato sempre fiducioso: era solo questione di tempo, ed in questa circostanza le cose sono andate fin troppo per le lunghe!

Ora sarebbe interessante verificare se la percentuale totale accreditata corrisponda esattamente a quella ufficiale, oppure sia comprensiva o meno dei tassi di cambio maturati alle varie scadenze. Mi rendo conto che ti chiedo un lavoro certosino, soprattutto in riferimento al tasso di cambio!!!

Ulteriore considerazione: data la valuta, dovresti controllare che ti versino anche l'ultimissima distribuzione di Maggio 2018.
 
Lehman Brothers’ failure pays off for hedge funds

Investors that bought up Lehman Brothers debt at reduced prices following its collapse ten years ago are set to see a windfall as PwC, which was charged with winding up the firm, prepares to ask a court to approve its plan to compensate the former creditors.

Among the firm's other hedge fund creditors that are set for a 140% return on their investments are King Street Capital and Carval after buying up Lehman's debt at exceptionally low prices.

A Korean bank that refused to honor an unsigned settlement after a judge ruled in its favor in a dispute with bankrupt lender Lehman Brothers Holdings Inc. asked the Second Circuit on Monday to reverse a judge’s finding that the deal was binding, saying the “plain vanilla” terms that weren’t addressed in mediation were actually complex.

Shinhan Bank said its confidential deal with Lehman was fully negotiated, but not yet binding, when Bankruptcy Judge Shelley Chapman dismissed the New York investment bank’s lawsuit

Dear Judge Chapman:

My firm is co-counsel for the Institutional Investors, together with their national counsel, Gibbs & Bruns LLP of Houston, Texas. We are pleased to report that the respective counsel to the Institutional Investors and the Trust Administrators have agreed on the text of a proposed order, with the sole exception of one portion of the penultimate decretal paragraph thereof (a copy of the proposed order is attached as Exhibit A). That paragraph reads as follows:

ORDERED that the terms of the RMBS Settlement Agreement shall be strictly enforced, including without limitation Sections 3.06(a)-(c) of that Agreement, which this Court interprets to require a "Pay First" order of operation, unless the terms of a particular Governing Agreement provide for a different order of operations; and it is further

The text in boldface is in dispute. The Institutional Investors respectfully submit that the Pay First interpretation should be included in the Court's order, and the Trust Administrators respectfully submit that it should not be.

The Institutional Investors refer the Court to the following portions of the Hearing Transcript (4/19/2018) in support of their view: 45:7-10, 45:25-46:7, and 47:8-11. The Trust Administrators refer the Court to the following portions of that Transcript in support of their contrary view: 51:17-20 and 55:7-21.1
Counsel for the Institutional Investors and the Trust Administrators, respectively, are available to answer any questions the Court may have, and thank Your Honor for your continued attention to this matter.
