Ancora polemiche su come interpretare la prolungata amministrazione fallimentare di Lehman Brothers tra chi sostiene che il giudice deve liquidare e chi sostiene che il giudice può anche riorganizzare l'entità qualora i dati economici lo consentano.
Ecco, secondo me l'una non esclude aprioristicamente l'altra: tutto si giocherebbe sul quantun possa essere ritenuto necessario per riorganizzare e portare nuovamente Lehman Brothers, o come diavolo possa essere chiamata la NewCo, sul mercato.
Secondo gli analisti, servirebbero almeno 4 miliardi di dollari per finalizzare l'operazione.
Ecco, secondo me l'una non esclude aprioristicamente l'altra: tutto si giocherebbe sul quantun possa essere ritenuto necessario per riorganizzare e portare nuovamente Lehman Brothers, o come diavolo possa essere chiamata la NewCo, sul mercato.

Ora, a parte che riguarda LBI ( e per motivi tecnici ), bisogna vedere se si terrà veramente o non faccia la fine di tante altre udienze cancellate e rimandate.

The Court was referred to the case of Lehman Brothers International (Europe) (in administration) v. CRC Credit Fund Ltd [2012] Bus LR 667, where the court held that both segregation of money into a separate bank account and a declaration of trust are necessary to create a trust. The mere segregation of money is not sufficient to establish a proprietary interest.
